These Terms and Conditions ("Terms") govern your use of this website and digital platform (the "Platform") operated by KNWN Health Nursing Corporation ("We," "Us," or "Our"). By accessing or using the Platform, you agree to these Terms.

Structure of Services

This Platform is owned and operated by KNWN Health Nursing Corporation, a California Professional Corporation. Clinical services, including telehealth consultations and prescriptions where clinically appropriate, are provided solely by licensed clinicians employed by or contracted with KNWN Health Nursing Corporation.

Provider Relationship

A provider-patient relationship is formed only after intake is completed and accepted by a licensed clinician affiliated with KNWN Health Nursing Corporation. Use of the Platform alone does not create a treatment relationship.

Telehealth Services

Clinical services are delivered via telehealth in accordance with California Business and Professions Code §2290.5. You acknowledge the inherent risks of remote care delivery, including technology limitations and the constraints of remote physical assessment, and agree to: (a) attend visits from a private, secure location; (b) accurately disclose your current physical location at the start of each visit; and (c) have a plan for accessing emergency services in your area. If a technology failure occurs during a visit, your clinician will attempt to contact you by phone. You retain the right to withdraw consent to telehealth at any time without affecting your right to future care.

Fees and Payment

KNWN Health Nursing Corporation is a cash-pay only practice. We do not accept, bill, or file claims with any private insurance, Medicare, or Medicaid. All fees are flat-rate and disclosed at the time of booking. Full payment is collected before services are rendered. Fees are established by KNWN Health Nursing Corporation and are subject to change with reasonable advance notice.

Cancellation Policy

Appointments cancelled or rescheduled at least 24 hours prior to the scheduled start time may be rescheduled without penalty. Cancellations within 24 hours or no-shows are non-refundable.

Credit Card Authorization

By providing a payment method, you authorize KNWN Health Nursing Corporation to charge the applicable session fees, late cancellation fees, and no-show fees for services scheduled through the Platform.

Compounded Medications and Off-Label Prescribing

Some medications prescribed through this Platform may be compounded preparations or may be prescribed for off-label uses. By using this Platform and accepting a prescription, you acknowledge and understand the following:

• Compounded medications are not FDA-approved drug products. They are prepared by a licensed compounding pharmacy and are not subject to the same pre-market approval, manufacturing standards, or safety and efficacy review as commercially manufactured FDA-approved drugs.
• Off-label prescribing means a medication is being used for a purpose, at a dose, or in a population not specifically approved by the FDA. Off-label use is lawful and common in medical practice.
• GLP-1 receptor agonists and peptides may be prescribed as compounded preparations or in doses/formulations not commercially available. Your clinician will discuss the clinical basis, potential benefits, and known risks with you before any prescription is issued.
• You have the right to ask questions and to decline any prescription. Requesting a consultation does not guarantee that a prescription will be issued.
• Compounded medications must be dispensed by a licensed compounding pharmacy. We will provide pharmacy information at the time of prescribing.

Nothing in this section limits your right to receive a complete explanation of any prescribed treatment from your clinician.

Communications Consent (CAN-SPAM and TCPA)

By using the Platform and providing your contact information, you consent to receive communications from KNWN Health Nursing Corporation, including emails, calls, and text messages for appointment reminders, administrative updates, and service notifications. Standard message and data rates may apply. You may opt out of non-essential communications at any time by replying STOP to any text message or by contacting us directly.

Privacy and HIPAA

KNWN Health Nursing Corporation is a HIPAA Covered Entity. Your protected health information is collected, used, and disclosed in accordance with Our Notice of Privacy Practices, available at knwnhealth.com and provided to you at intake. We also comply with the California Confidentiality of Medical Information Act (CMIA).

Acceptable Use

You agree not to misuse the Platform, attempt unauthorized access, disrupt services, upload malicious content, or record clinical sessions without prior written consent of the treating clinician.

No Medical Advice Disclaimer

General information on the Platform is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for guidance specific to your condition.

Limitation of Liability

To the fullest extent permitted by California law, KNWN Health Nursing Corporation shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, except as required by applicable law or professional standards of care.

Indemnification

You agree to indemnify and hold harmless KNWN Health Nursing Corporation, its officers, clinicians, employees, and agents from claims, losses, or liabilities arising from your use of the Platform, violation of these Terms, or provision of inaccurate information.

Arbitration of Disputes

Any dispute regarding the medical services provided under this agreement, including claims of medical malpractice, will be resolved through binding arbitration under California law rather than through a court or jury trial. By using this Platform, you and KNWN Health Nursing Corporation mutually agree to waive the right to a jury trial for such disputes. (California Code of Civil Procedure §1295.)

All other disputes relating to these Terms or your use of the Platform will likewise be resolved through binding arbitration in California under the then-current rules of the American Arbitration Association. This does not limit your right to seek emergency injunctive relief or to file a complaint with a licensing board or regulatory authority.

Force Majeure

KNWN Health Nursing Corporation is not liable for delays or failures caused by events beyond its reasonable control, including internet outages, technology failures, natural disasters, public health emergencies, or government actions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with Our Notice of Privacy Practices and any signed consent forms, constitute the entire agreement between you and KNWN Health Nursing Corporation regarding your use of the Platform and supersede all prior understandings on the same subject matter.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Accessibility and Non-Discrimination

KNWN Health Nursing Corporation does not discriminate on the basis of race, color, national origin, age, disability, sex, or any other characteristic protected by applicable law.
